1. Introduction

These Terms of Service ("Terms") govern your use of the GhignCardi Travel website (the "Website"), as well as the tours, experiences, and other travel services (collectively, the "Services") offered by GhignCardi Travel Ltd ("GhignCardi Travel", "we", "us", or "our"), a company registered in England and Wales (Company Number 12345678) with its registered office at 123 Kensington High Street, London, W8 5EG, United Kingdom.

By accessing our Website, making a booking with us, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Website or Services.

Please read these Terms carefully, as they contain important information about your legal rights, remedies, and obligations. By using our Website or Services, you acknowledge that you have read and understood these Terms.

2. Definitions

In these Terms, the following definitions apply:

  • "Booking" means the reservation of any Service offered by GhignCardi Travel.
  • "Customer" or "you" means any person who makes a Booking with GhignCardi Travel or uses the Website.
  • "Booking Confirmation" means the written confirmation of a Booking issued by GhignCardi Travel.
  • "Tour" means any organized travel experience, excursion, or activity provided by GhignCardi Travel.
  • "Tour Start Date" means the date on which a Tour is scheduled to begin, as specified in the Booking Confirmation.
  • "Force Majeure Event" means any circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, strikes, natural disasters, adverse weather conditions, epidemic, pandemic, or government actions.

3. Booking Process

3.1 Making a Booking

You can make a Booking through our Website, by email, by telephone, or through an authorized travel agent. All Bookings are subject to availability and our acceptance.

When you make a Booking, you must provide accurate and complete information, including the full names of all participants as they appear on official identification documents, contact details, and any special requirements.

3.2 Booking Confirmation

A contract between you and GhignCardi Travel will exist only when we send you a Booking Confirmation. The Booking Confirmation will specify the Services booked, the total price, payment schedule, and other relevant details.

Please check all details in the Booking Confirmation carefully and contact us immediately if any information is incorrect.

3.3 Age and Capacity

By making a Booking, you confirm that you are at least 18 years of age and have the legal capacity to enter into a contract. If you are making a Booking on behalf of other people, you confirm that you have the authority to make the Booking and to accept these Terms on their behalf.

4. Payment Terms

4.1 Deposits

For most Tours, a non-refundable deposit of 20% of the total price is required at the time of Booking. The exact deposit amount will be specified during the Booking process.

4.2 Final Payment

The balance of the total price must be paid no later than 60 days before the Tour Start Date. For Bookings made within 60 days of the Tour Start Date, full payment is required at the time of Booking.

4.3 Payment Methods

We accept payment by credit card, debit card, and bank transfer. All payments must be made in British Pounds (GBP) unless otherwise agreed.

4.4 Price Changes

The prices of our Tours are subject to change. However, once your Booking has been confirmed, the price of your Tour will not change except in the case of government action, currency fluctuations, or changes in transportation costs (including the cost of fuel), dues, taxes, or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports.

Any price increases will be communicated to you in writing at least 30 days before the Tour Start Date. If the price increase exceeds 8% of the total price of your Tour, you will have the option to cancel your Booking and receive a full refund.

5. Cancellation and Changes

5.1 Cancellation by the Customer

If you need to cancel your Booking, you must notify us in writing. The following cancellation fees will apply:

  • More than 60 days before the Tour Start Date: Loss of deposit
  • 59-30 days before the Tour Start Date: 50% of total price
  • 29-15 days before the Tour Start Date: 75% of total price
  • 14 days or less before the Tour Start Date: 100% of total price

We strongly recommend that you take out comprehensive travel insurance at the time of Booking to cover any cancellation fees.

5.2 Changes by the Customer

If you wish to make changes to your Booking after it has been confirmed, we will try to accommodate your request, but we cannot guarantee that changes will be possible. An administration fee of £50 per person may apply, plus any additional costs incurred in making the changes.

5.3 Cancellation by GhignCardi Travel

We reserve the right to cancel a Tour for any reason before the Tour Start Date. If we cancel a Tour (except due to a Force Majeure Event or your failure to pay), you will have the option of:

  • Accepting an alternative Tour of equivalent or higher standard (if available), or
  • Receiving a full refund of all monies paid.

If we cancel a Tour due to a Force Majeure Event, we will offer you an alternative Tour or a credit for future travel. If we cancel due to your failure to pay, the cancellation fees in section 5.1 will apply.

5.4 Changes by GhignCardi Travel

We reserve the right to make changes to a Tour before or during the Tour if necessary due to circumstances beyond our control or for operational reasons. If the changes are significant, we will notify you as soon as possible and offer you the option of accepting the changes, accepting an alternative Tour (with a refund of any price difference), or cancelling your Booking and receiving a full refund.

6. Tour Operation

6.1 Tour Leader Authority

Our Tour leaders and guides have the authority to make decisions affecting the wellbeing, comfort, and safety of the Tour group. You agree to respect and comply with their decisions and instructions at all times during the Tour.

6.2 Group Size

We reserve the right to operate a Tour with a smaller group size than advertised or to combine groups. If the group size is significantly smaller than advertised, we may adjust the services provided accordingly.

6.3 Itinerary Changes

While we make every effort to operate Tours as advertised, itineraries are subject to change due to circumstances such as weather conditions, transportation delays, or local events. We will not be liable for any loss, delay, inconvenience, disappointment, or expense resulting from such changes.

6.4 Accommodation

The accommodation provided will be as specified in the Booking Confirmation or of a similar standard. We reserve the right to change accommodation if necessary, but we will ensure that any alternative accommodation is of an equivalent or higher standard.

7. Customer Responsibilities

7.1 Travel Documents

You are responsible for ensuring that you have all necessary travel documents, including valid passports, visas, and health certificates, for all destinations visited during the Tour. We will not be liable for any consequences of your failure to obtain the necessary documents.

7.2 Health and Fitness

You must ensure that you are in good health and have an appropriate level of fitness for the Tour. If you have any medical conditions, disabilities, or special requirements, you must inform us at the time of Booking. We reserve the right to refuse a Booking or remove a person from a Tour if, in our reasonable opinion, their participation may endanger themselves or others, or if they disrupt the enjoyment of the Tour for others.

7.3 Behavior

You agree to behave in a responsible manner during the Tour, to respect local customs and laws, and to treat fellow travellers, our staff, and local people with courtesy and respect. If your behavior causes danger, distress, or annoyance to others, we reserve the right to terminate your participation in the Tour without refund.

7.4 Personal Belongings

You are responsible for the safety and security of your personal belongings throughout the Tour. We recommend that you take out comprehensive travel insurance that includes coverage for loss, theft, or damage to personal belongings.

8. Liability and Insurance

8.1 Our Liability

We will accept responsibility for the arrangements we agree to provide or arrange for you as an "organiser" under the Package Travel and Linked Travel Arrangements Regulations 2018, as amended. Subject to these regulations, we will not be liable for any injury, illness, death, loss, damage, expense, cost, or other claim of any description if it results from:

  • The acts and/or omissions of the person affected; or
  • The acts and/or omissions of a third party unconnected with the provision of the services contracted for and which were unforeseeable or unavoidable; or
  • Unusual or unforeseeable circumstances beyond ours or our suppliers' control, the consequences of which could not have been avoided even if all due care had been exercised; or
  • A Force Majeure Event.

Our liability, except in cases involving death, injury, or illness, shall be limited to a maximum of three times the cost of your travel arrangements.

8.2 Insurance

It is a condition of your Booking that you have adequate travel insurance that provides coverage for cancellation, medical expenses, repatriation, and personal belongings. We reserve the right to ask for proof of your travel insurance before the Tour Start Date.

9. Complaints

If you have a complaint during your Tour, you must inform our Tour leader or local representative immediately so that they can attempt to resolve the issue. If the issue is not resolved to your satisfaction, you should contact our office as soon as possible.

If you are still not satisfied, you must notify us in writing within 28 days of the end of your Tour, providing all relevant information and your booking reference. We will acknowledge your complaint within 7 days and aim to provide a full response within 28 days.

10. Website Use

10.1 Accuracy of Information

While we make every effort to ensure that the information on our Website is accurate and up-to-date, we do not guarantee the accuracy, completeness, or timeliness of the information. We reserve the right to correct any errors or omissions at any time without notice.

10.2 User Conduct

When using our Website, you agree not to:

  • Use the Website in any way that violates any applicable laws or regulations;
  • Use the Website to transmit any material that is defamatory, offensive, or otherwise objectionable;
  • Use the Website to impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity;
  • Interfere with or disrupt the operation of the Website or the servers or networks connected to the Website;
  • Attempt to gain unauthorized access to any portion of the Website or any other systems or networks connected to the Website.

10.3 Third-Party Links

Our Website may contain links to third-party websites. These links are provided for your convenience only, and we have no control over the content or availability of those websites. We do not endorse or accept any responsibility for the content, products, or services offered on third-party websites.

11. Intellectual Property

All content on our Website, including text, graphics, logos, images, audio clips, and software, is the property of GhignCardi Travel or its content suppliers and is protected by international copyright laws. You may not reproduce, modify, distribute, or republish any content from our Website without our prior written consent.

12. Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
